Consumer dispute resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
Welcome to Monka Studios! These Terms and Conditions ("Terms") govern your use of our website, monkastudios.com, (the "Site") and your purchase of 3D printed products ("Products") from us. By accessing our Site and purchasing our Products, you agree to be bound by these Terms. Please read them carefully.
For selected products, Monka Studios may offer a deposit payment option. If this option is available, the customer may choose to pay either the full product price at checkout or a 50% deposit at checkout.
The deposit payment option does not reduce or change the total product price. It only splits the payment into two parts: 50% due at checkout and the remaining 50% due when the order is ready to enter the painting stage.
By choosing the deposit payment option, the customer agrees to pay the remaining balance before the order continues into painting and final completion.
When the order is ready to enter the painting stage, Monka Studios will contact the customer and provide a payment request for the remaining balance. Painting and final completion will continue once the remaining balance has been paid.
If the remaining balance is not paid after the payment request and a reasonable reminder, Monka Studios may pause the order until payment is received.
If the customer does not pay the remaining balance within a reasonable time after the reminder, Monka Studios may cancel the order in accordance with the applicable cancellation provisions of these Terms.
Nothing in this section limits any mandatory consumer rights that cannot be excluded by law.
If you are a consumer purchasing from within the EU or UK, you have the legal right to withdraw from this contract within 14 days without giving any reason.
The right of withdrawal does not apply to:
If your item arrives defective or damaged, please contact us within 3 days of delivery with details and photographs/video. Where the product is confirmed defective, you are entitled to a repair, replacement, or refund, in accordance with consumer protection laws. This does not affect your statutory warranty rights.
You agree not to use the Site or Products for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Site. You agree not to attempt to gain unauthorized access to any parts of the Site or any systems or networks connected to the Site.
You agree to indemnify, defend, and hold harmless Monka Studios and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees, from any claim or demand, including reasonable attorneys' fees, made by any third-party due to or arising out of your breach of these Terms or the documents they incorporate by reference, or your violation of any law or the rights of a third-party, including without limitation any infringement of intellectual property rights related to Customer Designs.
These Terms and any separate agreements whereby we provide you Products shall be governed by and construed in accordance with the laws of Germany.
If any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms. Such determination shall not affect the validity and enforceability of any other remaining provisions.
These Terms and any policies or operating rules posted by us on this Site or in respect to the Products constitute the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us, including but not limited to any prior versions of the Terms.
