Terms and Conditions for Monka Studios

Welcome to Monka Studios! These Terms and Conditions ("Terms") govern your use of our website, monkastudios.com, (the "Site") and your purchase of 3D printed products ("Products") from us. By accessing our Site and purchasing our Products, you agree to be bound by these Terms. Please read them carefully.

1. General

• Acceptance of Terms: By using this Site, you confirm that you are of legal age to enter into a binding contract in your jurisdiction or have obtained parental or guardian consent to do so.
• Changes to Terms: We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the Site. Your continued use of the Site after such changes constitutes your acceptance of the new Terms.  
• Privacy Policy: Please review our Privacy Policy, which also governs your visit to our Site and is incorporated into these Terms.

2. Products and Orders

• Product Descriptions: We strive to describe our Products as accurately as possible. However, due to the nature of 3D printing, minor variations in color, texture, and finish may occur. Images on the Site are for illustrative purposes only. We do not warrant that Product descriptions or other content is entirely accurate, complete, reliable, current, or error-free.
• Order Acceptance: All orders are subject to acceptance by us. We reserve the right to refuse or cancel any order for any reason, including but not limited to Product availability, errors in Product descriptions or prices, or issues identified by our fraud detection services.  
• Custom Designs: If you provide your own 3D model or design for printing ("Customer Design"), you are solely responsible for the design and its specifications.
• Pricing: All prices are listed in EUR. Prices are subject to change without notice. The price charged for a Product will be the price in effect at the time the order is placed.

• Payment: Payment must be made in full at the time of ordering. We accept a variety of payment options through Shopify & PayPal. You agree to provide current, complete, and accurate purchase and account information for all purchases.  

3. Shipping and Delivery

• Shipping: We will ship Products to the address you provide during the ordering process. Shipping costs and estimated delivery times will be communicated at checkout.  
• Risk of Loss: The risk of loss and title for Products pass to you upon our delivery to the carrier.
• Delays: We are not responsible for shipping delays caused by the carrier, customs, or other circumstances beyond our reasonable control.
• Painted Products: Estimated delivery times do not apply to painted figures due to high demand. You'll be updated regulary on the progress of your painted order. Processing times can be up to 90 days.
• Order Status: You can check the current stage of your order at any time in your account.

3.1 Duties, Taxes & Customs Clearance (All Non-German Deliveries)

• We cover all duties and taxes for painted orders only.
• All other international shipments may be subject to import duties, taxes (including VAT/GST), and customs clearance or brokerage fees charged by the destination country’s authorities and/or the carrier. These charges are not included in our prices or shipping costs unless we explicitly say otherwise and are payable by you upon delivery. If charges are refused or unpaid, the parcel may be held or returned; original shipping costs and any return fees are non-refundable.

3.2 US Shipping

• Import Duties & Taxes (U.S. Customers): Effective August 29, 2025, low-value duty-free (“de minimis”) treatment has been suspended by U.S. authorities. All shipments from Germany to the United States may be subject to duties/taxes and admissibility requirements, regardless of order value. Orders are shipped on a DAP (duties & taxes unpaid) basis unless stated otherwise; you are responsible for any charges collected by U.S. Customs and/or the carrier upon delivery. Failure to pay may result in the package being held or returned; original shipping and any return fees are non-refundable.

3.3 European Union (EU) Deliveries

• For deliveries within the EU, no customs duties apply. VAT is charged in accordance with EU distance-selling rules (e.g., OSS/IOSS). Any local handling fees charged by the carrier remain your responsibility unless we state otherwise.

3.4 United Kingdom (UK) Deliveries

• For consignments ≤ £135, UK VAT is generally collected at checkout by the seller/marketplace; import duty does not usually apply. For consignments > £135, import VAT (and any applicable duties/fees) may be charged on arrival by the carrier or HMRC.

4. Returns, Refunds, and Cancellations

• If you are a consumer purchasing from within the EU or UK, you have the legal right to withdraw from this contract within 14 days without giving any reason.

  • Withdrawal period: The 14-day period starts on the day you (or a third party indicated by you, other than the carrier) receive the goods.

  • How to exercise: To exercise your right, you must notify us clearly (e.g. by email or post) before the withdrawal period expires. You may use the standard withdrawal form provided by law, but this is not mandatory.

  • Effect of withdrawal: If you withdraw, we will refund all payments received from you, including the cost of standard delivery (but not additional costs for express/alternative shipping), within 14 days of receiving your returned goods or of you providing proof of return, whichever comes first.

  • Refund method: Refunds will be made using the same payment method you used for the order, unless you agree otherwise. No fees will be charged for the refund.

  • Return of goods: You must return the goods to us without undue delay and in any event within 14 days from the day you notify us of withdrawal. You will bear the direct cost of returning the goods unless we state otherwise.

  • Condition of goods: You may handle the goods only as necessary to establish their nature, characteristics, and functioning. Any diminished value resulting from handling beyond this may be deducted from your refund.

  Exceptions to the Right of Withdrawal

  The right of withdrawal does not apply to:

  • Goods made to your specifications or clearly personalized;

  • Goods liable to deteriorate or expire rapidly;

  • Sealed goods which are not suitable for return due to health protection or hygiene reasons, if unsealed after delivery;

  • Digital content (downloads/streaming) if you agreed to immediate supply and acknowledged that you lose your right of withdrawal once supply has begun.

  Defective or Damaged Products

  If your item arrives defective or damaged, please contact us within 3 days of delivery with details and photographs. Where the product is confirmed defective, you are entitled to a repair, replacement, or refund, in accordance with consumer protection laws.

• Cancellations: 
  • Once production is underway, you can check your order status in your account to see if your order is still eligible for cancellation.
    
    

    • Order Status: Queued
      You can cancel your order via E-Mail or Discord and receive a full refund
      

    • Order Status: Printing
      Your order entered production. A cancellation is still possible, but we keep a 30% re-stock fee of the purchase price.

    • Order Status: Painting
      Your order entered painting production. A cancellation is still possible, but we keep a 60% re-stock fee of the purchase price.

    • Order Status: Dispatched / Sent
      Your order can't be cancelled anymore, it's been dispatched.

  • The customer retains the right to prove that no expenses were incurred by us or that they were substantially lower.

5. Intellectual Property

• Our Content: All content on this Site, including but not limited to text, graphics, logos, images, and software, is the property of Monka Studios or its content suppliers and is protected by international copyright and other intellectual property laws.  
• Our Designs: Designs created by Monka Studios and offered for sale remain our intellectual property. Purchase of a Product grants you a license to use the physical Product but does not transfer any design rights. You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of the Product designs without express written permission from us.
• Customer Designs:
  • You represent and warrant that you own or have all necessary rights, licenses, consents, and permissions to submit any Customer Design to us for printing.
  • You further represent and warrant that your Customer Design does not infringe upon any third-party rights, including but not limited to copyright, trademark, patent, trade secret, or other proprietary rights, and is not unlawful, obscene, defamatory, or otherwise objectionable.  
  • By submitting a Customer Design, you grant Monka Studios a non-exclusive, worldwide, royalty-free license to use, reproduce, modify (for manufacturing purposes), and display the Customer Design solely for the purpose of fulfilling your order.
  • We reserve the right to refuse to print any Customer Design that we, in our sole discretion, deem to be infringing, illegal, or otherwise inappropriate.
• No Reverse Engineering: You agree not to reverse engineer, decompile, or disassemble any Products or designs obtained from our Site.

6. User Conduct

You agree not to use the Site or Products for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Site. You agree not to attempt to gain unauthorized access to any parts of the Site or any systems or networks connected to the Site.  

7. Disclaimers and Limitation of Liability

• "As Is" Basis: The Site and the Products are provided on an "as is" and "as available" basis without any warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade.  
• Nature of 3D Printed Products: You acknowledge that 3D printed products may have inherent variations, surface finishes, and structural properties that differ from traditionally manufactured goods. We make no warranties regarding the specific performance, durability, or suitability of Products for specific applications unless explicitly stated. Products are generally intended for decorative or personal use unless otherwise specified.
• Limitation of Liability: To the fullest extent permitted by applicable law, Monka Studios, its directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Site or Products; (ii) any conduct or content of any third party on the Site; (iii) any content obtained from the Site; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.  
• Maximum Liability: In no event shall Monka Studios's aggregate liability for all claims relating to the Products exceed the amount paid by you for the Products in question.

8. Indemnification

You agree to indemnify, defend, and hold harmless Monka Studios and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees, from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms or the documents they incorporate by reference, or your violation of any law or the rights of a third-party (including, without limitation, any infringement of intellectual property rights related to Customer Designs).  

9. Governing Law

These Terms and any separate agreements whereby we provide you Products shall be governed by and construed in accordance with the laws of Germany.  

10. Severability

If any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms. Such determination shall not affect the validity and enforceability of any other remaining provisions.

11. Entire Agreement

These Terms and any policies or operating rules posted by us on this Site or in respect to the Products constitute the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms).
